General Provisions

1. These Terms of Use (hereinafter the “Terms”) regulate the relations between the Administration of the informational resource Metaportal (hereinafter the “Site”) and an individual (hereinafter the “User”) performing search, posting and distribution of information on this web resource at the address http://www.en.metaportal.ru .
2. The site is not a mass media. The resource Administration does not edit information posted by Users and is not responsible or liable for its content. Opinion of the Administration may not coincide with opinions of individuals posting information on the Site.
3. The Site respects and protects intellectual property rights and material and personal immaterial rights connected thereto. Use of informational materials without consent of the authors is allowed only under circumstances established by law.
4. A User posting information on the Site shall independently represent and protect his/her interests arising in relations with third parties in connection with posting the said information.
5. Administration shall provide the User the right to post the following types of information on the Site:

• text materials;
• audio materials;
• video materials;
• photo materials;
• links to materials posted on the Site or elsewhere.

Rights and Obligations of the User

User agrees that he/she is fully responsible and liable for the materials he/she posts on the Site. Administration shall not be liable for the contents of the materials or for their compliance with legislation, breach of copyright, unsanctioned use of trademarks, company names and logos, as well as potential breach of rights of third parties in connection with posting materials on the Site. In the event of complaints from third parties connected with posting materials on the Site, the user shall settle such complaints independently and at his/her own expense.

User acknowledges and agrees that information he/she posts may be used by search engines or other automated services or otherwise.

User shall be entitled to:

1. Perform search, receive, transfer, produce and distribute information on the Site by legal means, save for sections that are restricted or require a paid subscription;
2. Request from the Administration that all information provided by him/her, as well as his/her profile be concealed from other Users of the Site;
3. Change ratings of other Users and perform other actions, subject to compliance with Rules established by the Administration.

User shall:

1. Ensure reliability of information he/she provides;
2. When distributing information that was not created by the User ensure that it includes reliable information regarding the right holder of such information or other entity distributing information, in form and scope sufficient for identifying such entity;
3. Not distribute information aimed at propaganda, and/or inciting nationalistic, racist or religious hate or discord, as well as other information entailing administrative or criminal liability under the effective legislation;
4. Not breach the functioning of the Site by posting information containing viruses or creating additional load on the server through use of programs not provided for by the functional content of the Site or in other ways.

Rights and obligations of the Administration

Administration shall be entitled to:

1. Change or cancel the Rules of using the Site;
2. At its own discretion restrict access to any information posted by User, delete information posted by user or the User’s account;
3. Refuse to register the account of a User whose account and registration were deleted earlier for breach of these Terms.

Administration shall:

1. Protect the User’s account from unsanctioned access, destruction of information posted by the User, as well as other unlawful actions in respect of such information;
2. In the event the User posts information whose distribution is restricted or prohibited by the effective legislation, give the User notice and/or delete such information and/or delete the User’s account;
3. Provide all available information about the User to state bodies authorized for such in cases established by law.

Limitation of the Administration’s liability

1. Administration shall endeavor to ensure uninterrupted work of the Site; however, the Administration shall not be liable for the full or partial loss of materials posted by the Users, or for the insufficient quality or speed of the service.
2. The Site and its services, including all scripts, application, content and design are provided “as is”. Administration does not guarantee that the Site or its separate services may be fitting or unfitting for particular purposes. Administration does not guarantee or promise any specific results from the use of the Site and/or its specific services;
3. While using the Site, the User agrees that he/she is downloading from or with the use of the Site any materials at his/her own risk and bears personal liability for possible consequences of using the materials, including for damage which may be caused to his/her computer or to third parties, for loss of data or other harm which may be caused;
4. Administration shall reserve the right to change the Site design, its content, list and contents, to change or supplement the scripts used, software and other objects used or stored on the Site or any server application at any time, with or without prior notice;
5. Administration shall under no circumstances be liable toward the User or any third parties for any indirect, incidental or unintended damage, including loss of profit or lost data, damage to the honor, dignity or business reputation, caused by using the Site, the Site contents or other materials to which the User or other persons gained access using the Site, even in the event the Administration warned or indicated the possibility of such damage.

Limitations on posting information

Information posted by the Users on the Site shall not contain:  

• materials that are unlawful, harmful, threatening, offending to the morals, honor, dignity, rights and third-party interests protected by law, libelous, breaching copyright, promoting hatred and/or discrimination based on race, ethnic, sex or social attributes, promoting discord based on religion, race or nationality, containing scenes of violence or inhumane treatment of animals, etc.;
• impersonation of another person or representative of an organization and/or community without having sufficient rights for such, including impersonating staff or owner of the Site, as well as misleading in regard to the characteristics or properties of any subjects or objects;
• materials which the User has no right to make accessible by law or under any contractual relations;
• materials concerning any patent, trademark, commercial secret, copyright or other property rights and/or copyright and related rights of a third party;
• advertising material that has not been explicitly permitted or spam;
• materials containing computer code intended for breaching, destroying or restricting the functioning of any computer or telecommunications equipment or software, for performing unsanctioned access, as well as serial numbers to commercial software, logins, passwords and other means for gaining unsanctioned access to paid resources on the Internet;
• intentional or incidental breach of any applicable local, government or international laws;
• collection and storage of personal data of other users;
• unapproved transfer of recordings of advertising, commercial or propaganda nature;
• advertisement of narcotics;
• postings aimed at anyone, containing crude or offensive expressions or proposals;
• postings containing pornographic materials.

Disputes

1. Any disputes relating to these Terms shall be settled under the provisions of legislation of the Russian Federation.
2. An individual who feels that his/her rights and interests have been breached due to actions of the Administration or third parties due to any material being posted on the Site shall send a complaint. To do this the feedback system should be used (Ask a question), links to which are located at the top and bottom sections of the Site. On the page that opens write the issue of concern and your contact details if you would like to be contacted. Once the complaint is reviewed, the materials will be immediately removed from open access at first request of the legal right holder.

Final provisions

1. These Terms of Use may be amended by the Administration without any special notice. The latest version of the Terms is available at the link http://www.en.metaportal.ru/agreement .
2. These Terms of Use shall become effective from the time the User logs into the Site and shall be valid for an indefinite time period.
